Terms of Use
These terms are an agreement between you and Jayesh Porwal, who runs Enfilade ("Enfilade", "we", "us") for using Enfilade. By creating an account, signing in or otherwise using Enfilade, you agree to them. If you use Enfilade for a studio or company, you confirm you can agree on its behalf, and "you" includes it.
1. An early pilot
Enfilade is new. We are opening it in a small pilot, at founding prices, and improving it together with the studios who use it. By using it, you understand and accept that:
- you use Enfilade at your own risk, and can stop using it at any time;
- while we improve it, Enfilade may contain bugs or errors, and may sometimes be slow or unavailable;
- features may change, be improved or be replaced;
- projects, images, feedback, approvals and other data may be lost, damaged or become inaccessible, so you should keep your own copies and not rely on Enfilade as your only record;
- approvals and records in Enfilade are a convenience and are not a substitute for your own contracts, drawings and written agreements with your clients; and
- we may contact you about your experience of Enfilade.
2. The service
Enfilade lets architects and interior designers turn their floor plans and design material into presentations and design books, share them with clients through a link, and collect their feedback, approvals and revisions.
3. Your account
- You must be at least 18 and use Enfilade for professional purposes.
- Give accurate details and keep them up to date.
- Keep your password and sign-in codes private. You are responsible for what happens in your account, including by people on your team you give access to. Tell us straight away if you think someone else has accessed it.
4. Your content
You keep ownership of everything you upload or create in Enfilade, such as drawings, images, mood boards and notes ("your content"). You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, adapt and display your content only as needed to run, secure and improve Enfilade and to show it to the people you share it with. This licence ends when your content is deleted, apart from copies in backups for the short time described in our Privacy Policy.
You confirm that you own your content or have the rights and permissions needed to use it in Enfilade, including drawings, photos and other material made by others and information about your clients, and that using it does not break any law or anyone else's rights.
Images from websites, Pinterest, social media and other sources usually belong to someone else. Add them only if you have the owner's permission or a licence that allows it, or where the law otherwise allows you to use them, and only as reference within your own projects for your own clients. Where you can, keep the link to where an image came from; Enfilade keeps it with the image. You are responsible for the content you add and for any claim about it, and we may remove content that we believe infringes someone else's rights.
Copyright complaints
If you believe something in Enfilade infringes your copyright or other rights, email us at teamenfilade@gmail.com with your name and contact details, the work you say is infringed, the design book link or a description of where the content appears, and a statement that the information is accurate and that you own the rights or act for the owner. We will acknowledge your complaint within 24 hours and act on it within 15 days. We may remove or disable the content and tell the studio that added it, and the studio can reply if it believes the removal was a mistake. We close the accounts of studios that repeatedly add infringing content.
5. Sharing with clients
- Anyone who has a design book link can open it. You decide who receives your links and are responsible for sharing them only with the right people.
- You are responsible for your relationship with your clients, including telling them that their feedback and details are recorded in Enfilade.
- Clients use design books on these terms as well. They do not need an account.
6. Acceptable use
You must not:
- upload anything unlawful, harmful, misleading, or that infringes someone else's rights, including copyright and privacy;
- use Enfilade to send spam, malware or anything meant to deceive;
- try to break, overload, probe or get around the security or limits of Enfilade, or access data that isn't yours;
- copy, resell or reverse engineer Enfilade, or use it to build a competing product; or
- use automated tools to collect data from Enfilade without our written permission.
7. Plans, fees and payments
Plans
- First project: your first project is free, with no card needed.
- Project pass: one payment for one more project, with six months of client review. After that the project stays in your archive, where you and your client can still open it.
- Studio: a subscription, paid monthly or yearly, for as many projects as you take on.
- Atelier: Studio with your own web address and a client front we set up for your studio, priced and agreed in writing.
The plans, what each includes and their prices are on our pricing page. Prices are shown in your currency before you pay. Some plans may open later than others; a plan can be bought once the pricing page or your account offers it. In the app, Studio may still be called Premium for a while.
Paying
Our paid plans are sold through our online reseller, Dodo Payments, which acts as the merchant of record for your order. Dodo Payments processes the payment, issues your receipt or invoice, collects taxes such as VAT, GST or sales tax where they apply, and handles payment questions and refunds; its buyer terms also apply to your purchase. We never see or store your full card or UPI details.
Renewal and cancellation
Studio renews automatically at the end of each month or year, at the price then shown to you, until you cancel. You can cancel at any time; it then keeps working until the end of the period you paid for, and you are not charged again. A plan paid for a single period without automatic renewal simply ends at the end of that period. When a plan ends, your studio keeps all its projects in its archive. If we change the price of your plan, we will tell you at least 30 days before the new price applies to your next renewal, and you can cancel before then. A founding price stays the same for as long as your subscription continues without a break.
Refunds
Refunds are covered by our Refund and Cancellation Policy. In short: your first Studio payment is refunded in full if you ask within 14 days, and a Project pass is refunded in full within 14 days if its client link hasn't been opened.
Payments between you and your clients
Payment details you show your clients (such as a UPI ID or payment link) and any revision fees are entirely between you and your clients, and you are responsible for them, including any taxes.
8. Assistant features
Some optional features use automated tools to read drawings, suggest room names, write notes or make concept images. Their results can be wrong or incomplete, and concept images are illustrations, not designs or specifications. Check every result before you rely on it or share it.
9. Your feedback
If you send us ideas or suggestions, we may use them to improve Enfilade without any obligation to you.
10. Our rights
Enfilade, including its software, design, name and logo, belongs to us and our licensors. These terms give you a limited, personal, non-transferable right to use it while you follow them, and no other rights.
11. Suspension and ending
You can stop using Enfilade and delete your studio at any time from your account page. We may suspend or close your account, or remove content, if you break these terms, if it is needed to protect Enfilade or others, or if the law requires it. We may also end Enfilade itself, with reasonable notice so you can save your work, and will then refund the unused part of any period you have paid for. Sections 4 (the second paragraph), 7, and 12 to 18 continue after these terms end.
12. No warranties
Enfilade IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT ALLOWED BY LAW, WE MAKE NO WARRANTIES OR PROMISES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THAT Enfilade WILL BE ACCURATE, RELIABLE, SECURE, UNINTERRUPTED OR ERROR-FREE, THAT DATA WILL BE KEPT OR NOT LOST, OR THAT IT WILL BE FIT FOR A PARTICULAR PURPOSE. YOU USE IT VOLUNTARILY AND AT YOUR OWN RISK.
13. Limits on liability
TO THE FULLEST EXTENT ALLOWED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL LOSS, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, CLIENTS, CONTRACTS OR GOODWILL, OR FOR DISPUTES BETWEEN YOU AND YOUR CLIENTS, ARISING FROM OR RELATED TO YOUR USE OF Enfilade. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO Enfilade WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND INR 5,000.
Nothing in these terms limits liability that cannot be limited by law.
14. Indemnity
You agree to compensate us for reasonable losses and costs, including legal fees, arising from claims by others about your content, your use of Enfilade in breach of these terms, or your dealings with your clients.
15. Governing law and disputes
These terms are governed by the laws of India. The courts at Moradabad have exclusive jurisdiction over any dispute about them or Enfilade. Before going to court, we both agree to try to settle the dispute in good faith by contacting each other.
16. Changes to these terms
We may update these terms as Enfilade changes. If the changes are significant, we will tell you by email or in the app, and may ask you to accept them again. If you keep using Enfilade after the changes take effect, you accept them.
17. General
These terms and our Privacy Policy are the whole agreement between you and us about Enfilade. If any part is found unenforceable, the rest still applies. If we don't enforce a right straight away, we haven't given it up. You may not transfer these terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets. We are not responsible for delays or failures caused by events outside our reasonable control.
18. Contact
